Trademaster - Summary of cover

Simple rating structure - the premium is based on the number of persons insured - no wages estimates or adjustments are required.

Employers Liability

  1. £10,000,000 indemnity limit.
  2. Includes cover for Health and Safety at Work etc. Act - Legal fees, costs and other expenses (other than fines or penalties).
  3. Includes cover for Injury to Working Partners or Proprietors provided you have at least one manual employee.

Public and Products Liability

  1. Both premises and work away cover automatically included.
  2. Liability arising from injury, loss or damage caused by completed work which you or your employees have done away from the premises included.
  3. Includes liability arising from the use of plant as a tool of trade.
  4. Option to increase the £2,000,000 indemnity limit.

An outline of the insurance cover provided by our Trademaster Liability Insurance Policy is described below - but remember it is only an outline. It is the Policy, a legal document, which defines the insurance in precise terms. If you wish to see a specimen policy, please ask.

This optional cover provides Contract Works Insurance, i.e. loss or damage to the contract works whilst in progress and/or the materials provided for the contract.

Various levels of cover are available, based on the maximum value of any one contract.

Section One - Employers Liabiliy

This section provides the cover required under the law relating to compulsory insurance for injury to employees.However, it goes a good deal further.

  1. The protection provided has a £10 million limit.
  2. Legal costs and expenses in defending prosecutions under the Health and Safety at Work etc. Act 1974 are insured, as are the legal costs and expenses arising in connection with the Health and Safety Inquiries (Procedure) Regulations 1975.
  3. Youth Training Scheme trainees are deemed to be employees.
  4. If an employee is injured at work through the fault of a member of the public and despite a judgment in his favour is unable to obtain compensation, we shall settle the claim and seek to recover the compensation ourselves.

Section Two - Public and Products Liability

This section provides and indemnity for your legal liability for injury to public or loss of or damage to property not owned by you or in your custody or control. The main features are:

  1. £2,000,000 limit (which can be increased if required.
  2. We do not just cover bodily injury, we include certain "personal" injuries such as wrongful eviction, accusation of shoplifting etc.
  3. We do not just cover loss or damage to material property, but also pure economic loss arising from obstruction, trespass, nuisance or interference with any right of air, light or water or other easement.
  4. Defective Premises Act cover is automatically included.
  5. Cover is included for contingent motor third party liability arising out of the use of vehicles not owned by you within the United Kingdom.
  6. Your liability for loss or damage to premises hired or rented to you for the purpose of your business is also insured.
  7. Legal costs and expenses in defending prosecutions under the Health and Safety at Work Act etc. 1974 are covered, as are legal costs and expenses arising in connection with the Health and Safety Inquiries (Procedure) Regulations 1975.
The following special endorsements will apply in each case.
  1. This policy will not apply to any liability arising out of or in connection with:
    1. The use or application of any heat producing equipment away from the insured's own premises.
    2. Tree felling or lopping.
    3. The demolition or partial demolition of a building or structure except for the purpose of erection reconstruction alteration maintenance or repair by on or behalf the insured.
    4. Any work of demolition piling or water diversion or the use of explosives.
    5. The construction alteration maintenance or repair of viaducts, bridges, docks, tunnels, dams, reservoirs, towers, steeples, chimney stacks, shafts or blast furnaces.
    6. The making of excavations exceeding in any part a depth of 8 metres.

  2. In respect of any claim for loss or damage to cables pipes or other services located underground it is a condition precedent to liability that the Insured prior to undertaking digging boring or excavation has:
    1. Taken or caused to be taken all responsible measures to identify the location of such cables pipes and services before any work is commenced which may involve a risk of damage thereto. Reasonable measures include the use of the "Dial Before You Dig" service by dialing freefone 111 where it is possible British Telecom cables are under the site.
    2. Retained a written record of the measures which were taken to locate such cables pipes or other services.
    3. Adopted or caused to be adopted a method of work which minimises the risk of damage to such services.
    4. Conveyed the location of such cables pipes and services to those who are carrying out such work on behalf of the Insured.

IMPORTANT: These terms only apply if you have not had any liability claims over the past three years - other risks will be considered on application.

Those Eligible

Limited Companies, partnerships and self employed persons, partners, proprietors, directors or employees engaged in Groundwork or Civil Engineering or Site Clearance or Plant Hire and working in Great Britain, the Isle of Man or the Channel Islands.

Indemnity Limits

Public and Products Liability - £2,000,000 (which can be increased if required) in one period of insurance for liability arising from the supply of goods and in any event for other liability insured under the Section.

  1. There are no limits of indemnity.
  2. There is no limit to the number of claims which can be made in any one period of insurance. Employers Liability £10,000,000 (which can be increased if required).

Excesses

  1. £500 in respect of loss of or damage to property, including the Contract Works Extension.
  2. £500 in respect to loss or damage to underground services
